General conditions
BOOKING- TERMS AND CONDITIONS
By making a reservation with MALLORCA VILLA SELECTION (hereinafter MVS) the customer accepts the following ‘Terms and Conditions’:
1. THE RESERVATION
Reservations must be made in writing, by email. MVS shall confirm the reservation in writing via the same means. The customer must honor the number of guests and animals confirmed in the reservation.
2. PRICES/OFFERS
The prices that are valid for a reservation shall always be those published on the website at the time it is made.
MVS reserves the right to publish last-minute offers without prior notification and at them convenience. Therefore, the customer may not request a discount or price reduction after the reservation is confirmed.
3. METHOD OF PAYMENT
At the time of your booking, you will be asked to pay an initial deposit of 20% of the total rental cost of the property. When you pay the first instalment, you confirm at the same time that you have read and accepted our general terms and conditions. MVS reserves the right to cancel the booking if the first instalment of 20% of the rent has not been received within 4 business days after the reservation is made. Payments can either be made by bank transfer, credit card or debit card. If paying by bank transfer, we will hold your selected property for 4 business days while you arrange payment. All card transactions are billed in EUR. We accept Visa and MasterCard.
4. LIABILITIES
The descriptions, photos and other information published on the website reflect the
characteristics of each property at the time they were uploaded on the website. Furthermore, MVS hereby undertakes to update such information in as much as possible. Therefore, the information and the published photos may change without prior notification. MVS shall not be held liable for possible changes to the furnishings or appliances that may take place between the reservation being confirmed and the customer arriving at the property.
MVS shall not be held liable for possible modifications arising from force majeure, such as strikes, wars, earthquakes, power or water supply cuts, storms, works performed in close proximity to the property and other circumstances that were unforeseeable at the time the reservation was made.
Neither shall MVS be held liable for electrical appliances, heating systems, air conditioning systems, the swimming pool or the internet, etc. not working properly. While MVS regularly checks that the equipment at each property is working, this ultimately depends on the owner of the property. If the customer discovers that any piece of equipment does not work properly, they must contact MVS immediately, in order for the owner of the property to resolve the issue. Despite the foregoing, the customer must bear in mind that there will be a period of time between the issue being detected and it being resolved. Thus, MVS shall not pay or be held liable for potential complaints arising from the equipment not working properly subsequent to the guest checking out from the property.
The customer shall be liable for the proper use of the property, including the objects located inside the property, such as electrical appliances, furnishings, etc., and outside of the property, such as the swimming pool, barbeque, etc.
MVS shall not be held liable for possible accidents that may take place during your stay, or robberies or thefts of any type of object located inside or outside of the contracted property.
All complaints must be made in writing to the owner of the property or MVS.
5. BREAKDOWNS/BREAKAGES
The customer hereby undertakes to respect both the property and all the items located therein. In the event of a breakage or breakdown, the customer must contact the owner or MVS within a maximum period of 24 hours in order for such breakdown or breakage to be repaired. Furthermore, financial compensation may be claimed from the customer in the event that the breakage or breakdown is attributable to them.
6. MODIFICATIONS/CANCELLATIONS BY MVS
MVS shall cancel the contract for the following reasons:
a) …breakages or breakdowns arising from misuse by the customer or the accompanying parties
thereof.
b) …noises or disturbances suffered by neighbors and other people.
c) …Failure to respect the rules that the owner imposes on their property, such as the hours at which the swimming pool can be used, use of the air-conditioning system, etc.
d) …Failure to pay the remaining amount of the total reservation price at time or the extras when they are given the keys or failure to pay a deposit when required by the specific property.
In this case, the customer will lose the confirmation deposit.
7. CANCELLATION FEE
The following cancellation charges apply:
Cancellation and payment conditions may be varied. Enter the dates of your stay and consult the conditions. The conditions written in the rental contract always apply. The service fee (Servicecharge) is not refundable.
In case of NO SHOW, the guest loses 100 % of the amount of the rent.
If the guest does not show up at the property the day of arrival, it will be considered as NO SHOW, the agency will then charge the whole amount of the booking. We highly recommend to contract a travel assurance.
8. PRIVACY TERMS
In compliance with current legislation (article 12 Law 15/1999 13th December) regarding Personal data protection, we inform you that your personal data has been incorporated in an automatic file under the supervision and responsibility of the Mallorca Villas Selection(EFESO S.L.) with the aim of attending all issues coming from the business relations maintained with you and the enterprise.
